Nick Kyrgios has admitted to assaulting his ex-girlfriend Chiara Passari after failing to get his case dismissed on mental health grounds on Friday.
Kyrgios pushed her onto the pavement during a row in 2021, the court heard but he was spared a criminal conviction as the magistrate called the incident 'a single act of stupidity and frustration'.
Facts tendered to the court say he pushed her after she stopped his car from driving away when they were arguing in January 2021 and she reported it the following month with no formal complaint but this was changed when they broke up in December of that year.
According to his lawyer, Michael Kukulies-Smith, he argued Kyrgios tried to de-escalate it by calling an Uber and apologized the next day showing guilt.
"It is in that context and the frustration that resulted, that my client reacted and the offence occurred," he said.
"There is a relationship between the mental health and the offending - even though he no longer suffers it to the same extent today."
"You acted in the heat of the moment," said Magistrate Beth Campbell when sentencing Kyrgios.
"I am dealing with you in the same way I would deal with any young man in this court. You are a young man who happens to hit a tennis ball particularly well."
